Terms of Service
These terms govern your access to and use of Opswell. By using the Service, you agree to them on behalf of your organisation.
1. The Service
Opswell provides a hosted maintenance operations platform. We may add, change, or remove features over time, and we work to give reasonable notice of material changes that affect how you use the Service.
2. Accounts
You are responsible for the accounts under your organisation, for keeping credentials confidential, and for the activity that happens under them. Notify us promptly if you believe an account has been compromised.
3. Acceptable use
You agree not to misuse the Service — including attempting to disrupt it, access it without authorisation, or use it to store unlawful content. We may suspend access where use threatens the security or integrity of the Service.
4. Customer data
Your organisation owns the data it puts into the Service. You grant us the rights needed to host and process that data to provide the Service, as described in our Privacy Policy and any data processing agreement in place.
5. Availability
We aim for high availability and publish our operational status. From time to time the Service may be unavailable for maintenance or reasons outside our control. Specific commitments, where offered, are set out in your order or service level agreement.
6. Fees
Paid plans are billed as described in your order. Fees are based on the assets under management and are non-refundable except where required by law or expressly stated.
7. Warranties & liability
The Service is provided “as is” to the extent permitted by law. Neither party is liable for indirect or consequential losses, and each party's total liability is limited as set out in your agreement.
8. Termination
Either party may end the agreement as described in your order. On termination, we make your data available for export for a limited period, then delete it in line with our retention schedule.
